Terms of Service

Welcome to Pocket Car. These Terms of Service (“Terms”) govern your use of the Pocket Car mobile application and related services (collectively, the “Service”) operated by Pocket Car (“we”, “us”, “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Pocket Car is a mobile application designed for car dealers, showrooms, importers, and their sales teams. The Service enables users to:

• Track vehicles for purchase and sale
• Manage client needs and match them with available inventory
• Collaborate with team members through shared workspaces
• Track costs, margins, and activity

2. Account Registration

2.1 Account Required

To use Pocket Car, you must create an account by providing your full name, email address, and a password.

2.2 Account Responsibilities

You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

If you suspect unauthorized access to your account, contact us immediately at support@pocketcar.app.

2.3 Age Requirement

You must be at least 16 years old to create an account and use Pocket Car. By using the Service, you represent that you meet this requirement.

3. Teams and Collaboration

3.1 Team Creation

Any user can create a team. The creator becomes the team owner.

3.2 Team Membership

Team members are added via email invitation. By joining a team, you agree that:

• Other team members can see your name, email address, and all data you contribute to the team
• Data you add to a team (vehicles, needs, activity) is visible to all current and future members of that team
• The team owner and admins can manage membership, including removing members

3.3 Data Ownership

You retain ownership of the data you enter into Pocket Car. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.

When you leave or are removed from a team, data you contributed to that team remains accessible to the team.

4. Subscriptions and Payments

4.1 Free and Paid Plans

Pocket Car offers a free plan with limited features and paid subscription plans with expanded capabilities. Details of plan limits and pricing are displayed within the app.

4.2 Payment Processing

Payments are processed through Apple’s App Store (for iOS) and Stripe (for direct billing). By subscribing, you also agree to the payment processor’s terms:

4.3 Subscription Terms

• Subscriptions are billed on a recurring basis (monthly or yearly) as selected at the time of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your Apple ID account settings or through the app

4.4 Refunds

For purchases made through the App Store, refund requests must be directed to Apple in accordance with their refund policy. For direct billing through Stripe, refunds are handled on a case-by-case basis — contact us at support@pocketcar.app.

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of the next billing cycle after notice is provided.

5. Acceptable Use

5.1 You agree to:

• Use the Service only for its intended purpose of vehicle inventory and sales management
• Provide accurate information about vehicles, clients, and transactions
• Respect the privacy and data of your team members and clients

5.2 You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to other users’ accounts or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service
• Circumvent or attempt to circumvent subscription limits or payment requirements
• Exploit bugs, errors, or vulnerabilities in the Service
• Upload malicious files, viruses, or harmful code
• Resell, redistribute, or sublicense access to the Service

5.3 Enforcement

We reserve the right to suspend or terminate your account if you violate these Terms, without prior notice and without liability.

6. User Content

6.1 Your Content

You are solely responsible for all content you upload, enter, or share through the Service, including vehicle data, client information, images, and descriptions (“User Content”).

6.2 Content Standards

You represent that your User Content:

• Does not infringe the intellectual property rights of any third party
• Is accurate to the best of your knowledge
• Complies with all applicable laws and regulations
• Does not contain personal data of third parties without their consent

6.3 License

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely for the purpose of operating and providing the Service. This license terminates when you delete the content or your account.

7. Intellectual Property

7.1 Our Property

The Service, including its design, code, features, branding, and documentation, is owned by Pocket Car and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

7.2 Feedback

If you provide us with suggestions, ideas, or feedback about the Service, you grant us the right to use them without restriction or compensation.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy at https://pocketcar.app/en/privacy to understand how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

9. Third-Party Services

The Service integrates with third-party providers (including Neon, AWS, Stripe, and Better Auth). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Data will not be lost or corrupted
• The Service will meet your specific requirements
• Results obtained from the Service will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POCKET CAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or data corruption
• Business interruption
• Any damages arising from reliance on information provided through the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise).

12. Indemnification

You agree to indemnify, defend, and hold harmless Pocket Car, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any rights of a third party

13. Account Termination

13.1 By You

You may delete your account at any time through the app (Settings → Danger Zone → Delete Account). Account deletion is permanent and cannot be reversed.

13.2 By Us

We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, extended inactivity, or discontinuation of the Service.

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data in accordance with our Privacy Policy
• Active subscriptions should be cancelled through your payment provider
• Provisions that by their nature should survive termination will remain in effect (including Sections 10, 11, 12, and 14)

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in Poland.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the “Effective Date” at the top of this page
• Notify you through the app or by email

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and delete your account.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pocket Car regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
